<font face="Arial">Hôm 30-12-2010, ĐTC Biển Đức 16 đã ban hành Tự Sắc về
những biện pháp phòng chống rửa tiền đến từ các hoạt động phạm pháp và
chống tài trợ khủng bố, đồng thời thành lập cơ quan đặc trách vấn đề
này.<br>
<br>
Quyết định của ĐTC được trình bày trong Tông Thư Tự Sắc trong đó ngài
nêu lý do của quyết định:<br>
<br>
”Tòa Thánh vẫn luôn lên tiếng nhắn nhủ mọi người thiện chí, nhất là các
vị lãnh đạo quốc gia, dấn thân xây dựng thành thị phổ quát của Thiên
Chúa mà lịch sử cộng đồng các dân nước đang tiến tới, qua một nền hòa
bình công chính và lâu bền ở mọi nơi trên thế giới (..). Đáng tiếc là,
ngày nay trong một xã hội ngày càng hoàn cầu hóa, hòa bình bị đe dọa vì
nhiều lý do, trong đó có sự lạm dụng thị trường và kinh tế, nhất là bạo
lực kinh khủng và tàn hại mà nạn khủng bố gây ra, gieo chết chóc, đau
thương, oán thù và xáo trộn xã hội.<br>
<br>
”Điều rất thích hợp là cộng đồng quốc tế ngày càng trang bị những nguyên
tắc và phương tiện pháp lý giúp phòng ngừa và ngăn chặn hiện tượng tẩy
tiền và tài trợ khủng bố. Tòa Thánh ủng hộ quyết tâm đó và muốn chấp
nhận các quy luật ấy trong việc sử dụng tài nguyên vật chất nhắm chu
toàn sứ mạng và các công tác của Quốc gia thành Vatican”.<br>
<br>
”Trong khuôn khổ đó, và thi hành Hiệp Ước tiền tệ giữa Quốc gia Thành
Vatican và Liên hiệp Âu Châu ngày 17-12-2009, tôi cũng phê chuẩn cho
Quốc gia này việc ban hành các luật về việc phòng ngừa và chống rửa tiền
từ các hoạt động phạm pháp và việc tài trợ khủng bố, được ban hành ngày
30-12-2010 này.”<br>

ĐTC cho biết qua Tự Sắc này, ngài qui định các luật vừa nói cho Quốc gia
Thành Vatican cũng có hiệu lực đối với các cơ quan Trung Ương Tòa Thánh
và các cơ quan phụ thuộc khác của Tòa Thánh, nghĩa là trong đó có cả
”Viện Giáo Vụ” (IOR), quen gọi là ”Ngân hàng Vatican”.<br>
<br>
Đồng thời ngài thiết lập Cơ quan Thông Tin Tài Chánh (Autorità di
Informazione Finanziaria) gọi tắt là AIF như một Cơ quan phụ thuộc của
Tòa Thánh và phê chuẩn qui chế của cơ quan này.<br>
<br>
ĐTC cũng ủy cho các cơ quan thẩm quyền của Quốc gia thành Vatican quyền
được thi hành quyền tài phán về hình luật đối với các cơ quan Trung Ương
Tòa Thánh và các cơ quan phụ thuộc.<br>
<br>
Ngoài ra, theo qui chế của cơ quan AIF được ĐTC phê chuẩn, cơ quan này
có một vị Chủ tịch do ĐTC bổ nhiệm, với nhiệm kỳ 5 năm có thể được tái
bổ nhiệm. Vị chủ tịch chủ tọa Hội đồng chỉ đạo gồm 4 thành viên do ĐTC
bổ nhiệm. Cơ quan AIF có một vị Giám đốc và các nhân viên.<br>
<br>
<b>Luật chi tiết chống rửa tiền</b><br>
<br>
Cùng với các văn kiện trên đây, Hội đồng Tòa Thánh đặc trách quốc gia
thành Vatican, đã ban hành bộ luật chi tiết gồm 43 điều khoản liên quan
đến các loại tội và hình phạt tương ứng về việc tẩy tiền và tài trợ
khủng bố, việc kiểm soát, thông báo, đăng ký, v.v.. Chẳng hạn người nào
phạm tội rửa tiền sẽ bị phạt từ 4 đến 12 năm tù và phạt tiền tới 15 ngàn
Euro.<br>

Cha Lombardi, Giám đốc phòng báo chí Tòa Thánh cho biết từ lâu các hoạt
động bất hợp phép đã chứng tỏ khả năng len lỏi và làm ô nhiễm thế giới
kinh tế và tài chánh; sự phát triển của chúng trên bình diện quốc tế và
việc sử dụng tác kỹ thuật mới càng gia tăng khả năng xâm nhập và ẩn nấp
của chúng, vì thế để tự vệ, cần phải cấp thiết thành lập một mạng kiểm
soát và thông tin với nhau giữa các giới hữu trách chống lại các tệ nạn
đó.<br>
<br>
Trong bối cảnh ấy, các qui luật mới được ban hành tại Tòa Thánh nhắm đáp
ứng toàn thể những đòi hỏi: một đàng bảo tồn hoạt động hữu hiệu của các
cơ quan trong lãnh vực kinh tế và tài chánh để phục vụ Giáo Hội Công
Giáo trên thế giới, và đàng khác đáp ứng đòi hỏi luân lý về sự ”minh
bạch, lương thiện và trách nhiệm” trong lãnh vực xã hội và kinh tế.<br>
<br>
Với các qui luật trên đây, người ta sẽ tránh được những lầm lẫn, dễ trở
thành gương xấu đối với dư luận quần chúng và các tin hữu. Nói khác đi,
với các biện pháp này, Giáo Hội sẽ được uy tín hơn trước mặt cộng đồng
