Có thể xin Phép Chuẩn (Dispensation) hay Xin Phép (Permission) tại Toà
án Hôn phối (Tribunal) của Địa phận tuỳ theo từng trường hợp. Nên nhớ,
có những luật trừ tuỳ nố (case) và tuỳ nơi, xin liên lạc với linh mục sở
tại để biết thêm chi tiết.</p>

2. HÔN NHÂN CÓ GIẤY HÔN THÚ ĐỜI</p>

Ngăn trở giây hôn phối hay tiền hôn nhân có nhiều loại khác nhau. Chúng
ta cần phân biệt các mối dây liên hệ hôn phối này. Hôn nhân giữa hai

3. Một người Công giáo lập gia đình với một người không Công giáo
(non-baptized) ở tòa đời. Thiếu mô thức (lack of form).</p>

4. Hai người không Công giáo (non-baptized) lập gia đình tại toà đời
hoặc tại chùa chiền.</p>

Thời gian sau, ly dị để một trong hai người này muốn lập gia đình với
một người Công giáo. Người đó ước muốn rửa tội hoặc đã rửa tội (Công
giáo hoặc Tin lành) hoặc (không rửa tội) để lấy người Công giáo. Trường
hợp này sẽ có nhiều vấn đề cần giải quyết liên quan đến Đặc quyền của
Thánh Phaolô và Thánh Phêrô.</p>

a. Đặc quyền của Thánh Phaolô (Pauline privilege)</p>

Giáo hội Công giáo công nhận mọi hôn nhân đã thành lập là thành sự
(valid) và hợp pháp (licit), không có vấn đề nơi đâu họ đã cử hành, đây
là nguyên lý của Luật Tự nhiên. Hôn nhân giữa hai người không được rửa
tội (non-baptized) vẫn có giá trị và chỉ được giải bởi cái chết của một
bên. Nên trường hợp hai người chưa rửa tội đã lập hôn nhân và chung
sống, một trong hai người muốn ly dị (trước đó hoặc sau này) để rửa tội
gia nhập đạo Công giáo hoặc Tin lành (Christian) và lập gia đình với một
người Công giáo; họ phải xin phép chuẩn đặc quyền của thánh Phaolô. Toà
án Hôn phối Địa phận có quyền lo giải quyết vấn đề.</p>

b. Đặc quyền của Thánh Phêrô (Petrine privilege)</p>

Cũng như trường hợp trên, hai người chưa rửa tội lập gia đình và chung
sống (hoặc ít nhất một trong hai người lập hôn phối trước là chưa rửa
tội). Một trong hai người muốn ly dị (trước đó hoặc sau này), họ không
muốn được rửa tội nhưng muốn cưới một người Công giáo. Họ cần phải lo
thủ tục giấy tờ xin phép chuẩn với đặc quyền của Thánh Phêrô. Toà án địa
phận sẽ gửi hồ sơ qua Toà Thánh (Holy See) để quyết định.</p>

3. PHÉP CHUẨN</p>

Đối với một người Công giáo đã lập gia đình với bất cứ người nào (rửa
tội hay chưa rửa tội) và nếu không có phép chuẩn hay được phép của Giáo
Hội hoặc không cử hành Hôn phối trong nhà thờ Công giáo đều mắc ngăn
trở. Theo Luật trong đạo, họ không được thông công qua các Bí tích trong
Giáo Hội.</p>

Muốn được hợp thức hoá Hôn Phối (convalidation) để thông công trong đời
sống ân sủng của Giáo Hội, họ cần làm đơn xin Phép Chuẩn hoặc Xin Phép
với Toà án Hôn phối trong Địa phận. Trường hợp tiền hôn nhân với người
có đạo hoặc không có đạo, cần điền đơn xin Tiêu Hôn (Declaration of
Nullity), sau khi đã hoàn tất giấy ly dị ở toà đời.</p>

Trường hợp người Công giáo muốn cử hành Hôn phối trong nhà thờ nhưng hai
người khác Nghi thức tôn giáo nhưng có rửa tội thành sự (Orthodox,
Eastern Rite, Christian...) cần điền đơn để Xin Phép (Permission for
Mixed Marriage). Hôn nhân khác Đạo, không có rửa tội (Jewish, Buddhism,
Muslim…) cần điền đơn để xin Phép Chuẩn (Dispensation from Disparity of
Worship) tại Văn phòng Chưởng ấn (Chancery). Trong những trường hợp
trên, linh mục sở tại không có quyền chuẩn chước hay cho phép (trừ khi
được chỉ định bởi đấng bản quyền).</p>

4. BÍ TÍCH HÔN PHỐI</p>

Các cặp hôn nhân không có bất cử ngăn trở nào được tự do lập hôn phối.
Cả hai người được rửa tội trong Đạo Công giáo, đã qua các lớp dự bị hôn
nhân, đệ trình các giấy tờ Rửa Tội, Rước Lễ Lần Đầu, Thêm Sức và qua
việc Điều tra Hôn phối (PMI - Pre-marriage Investigation). Tuỳ theo sự
đòi hỏi của mỗi nơi, ở Hoa Kỳ, một số tiểu bang cần trình Giấy Đăng ký
Kết hôn (Marriage license) hoặc Giấy Hôn thú (Certificate of Marriage).</p>

Sau khi hoàn tất các thủ tục cần thiết, lễ Hôn phối được cử hành trong
thánh đường Công giáo. Có sự hiện diện của đôi hôn phối, hai người nhân
chứng và linh mục hay thầy sáu có năng quyền hoặc được uỷ quyền cử hành
nghi thức Bí tích Hôn Phối. Chính đôi hôn phối sẽ trao ban Bí tích cho
nhau. Bí tích Hôn Phối sẽ thành sự và hợp pháp khi hai người đã hoàn tất
Nghi lễ Hôn phối trong thánh đường và sau đó chung sống với nhau thành
vợ chồng. Khi Bí tích Hôn Phối đã thành sự, không ai có quyền tháo cởi.</p>

Những trường hợp các cặp hôn nhân đã cử hành Bí tích Hôn Phối trong nhà
thờ đầy đủ nhưng sau này ly dị và muốn được huỷ hôn. Họ có quyền nộp đơn
lên Toà án Hôn phối của Địa phận để được điều tra và xét duyệt. Nếu nố
hôn phối (Marriage case) đó có mắc ngăn trở hoặc thiếu xót điều chi
trước khi cử hành Bí tích Hôn Phối, Toà án sẽ dựa vào Giáo luật để phán
quyết.</p>
