Vị chứng hфn lа người hiện diện để yкu cầu hai bкn kết ước biểu lộ sự
ưng thuận vа để nhвn danh Giбo Hội chấp nhận sự biểu lộ ấy (Điều 1108
§2). Theo Giбo Luật, hфn nhвn chỉ thаnh sự khi được kết ước trước mặt vị
chứng hфn:</span></p>

- Đấng Bản Quyền địa phương (Giбm mục Giбo phận, Tổng Đại diện, Đại diện

Điều 1111 quy định về việc ủy quyền chứng hфn:</span></p>

quyền tổng quбt, thм phải ban bằng văn bản”.</span></p>

Đấng Bản Quyền địa phương vа cha sở đang thi hаnh chức vụ cбch thаnh sự
đều cу thể ủy quyền cho bất cứ linh mục hoặc phу tế nаo để chứng hфn
trong phạm vi địa hạt của mмnh.</span></p>

Quyền ủy cу thể được ủy quyền tổng quбt cho mọi trường hợp hoặc riкng

Quyền ủy tổng quбt cу thể được tбi ủy cho từng việc riкng biệt, nhưng
quyền ủy cho từng đбm hфn phối riкng biệt khфng được tбi ủy nếu khфng cу
phйp rх rаng của vị ủy quyền (Điều 137 §3). Khфng một quyền nаo đг được
tбi ủy, lại cу thể tбi ủy lần nữa (tбi tбi ủy), trừ khi vị ủy quyền minh
nhiкn cho phйp (Điều 137 §4).</span></p>

Việc uỷ nhiệm năng quyền chứng hфn phải hội đủ những điều kiện như sau:</span></p>

<strong style="box-sizing: border-box; font-weight: bold">1/. Sự ủy
quyền phải được minh nhiкn ban cho những người nhất định</strong></span></p>

<span style="box-sizing: border-box; font-family: arial, helvetica, sans-serif; font-size: 14px">
- Một linh mục hay phу tế phải được chỉ định rх rệt : tкn hay
chức vụ.</span></p>

<span style="box-sizing: border-box; font-family: arial, helvetica, sans-serif; font-size: 14px">
- Ủy quyền bằng điện thoại hay bằng miệng cũng được . Trực
tiếp với vị đу hay giбn tiếp nhờ người khбc cũng được.</span></p>

<span style="box-sizing: border-box; font-family: arial, helvetica, sans-serif; font-size: 14px">
- Cу thể ủy quyền cho nhiều vị chứng hфn trong cщng một hфn phối, miễn
lа mỗi vị được xбc định tкn vа chức vị rх rаng. Trong trường hợp thừa ủy
cбch liкn đới nаy, ai hаnh động trước thм được ưu tiкn: “Khi nhiều người
đг được thừa uỷ theo cбch liкn đới để lаm cщng một cфng việc, người nаo
đг khởi sự lаm trước, thм sẽ loại trừ những người khбc khỏi cфng việc
đу, trừ khi sau đу người ấy bị cản trở hoặc khфng muốn tiếp tục lаm nữa”
(Điều 140 §1). Vм thế, để trбnh lộn xộn xảy ra, tốt nhất cần nуi rх danh
tбnh vа thứ tự.</span></p>

Phải nуi rх tкn của đфi bạn hoặc ngаy giờ hay nơi cử hаnh, miễn sao
đừng cу nguy cơ lẫn lộn với đбm khбc .</span></p>

Trong trường hợp ủy quyền riкng biệt, vẫn cу thể ủy quyền cho một linh

Cha sở khфng thể chứng hфn thаnh sự cho những người thuộc quyền ở ngoаi
địa hạt của mмnh (x. Điều 1109), vм thế cũng khфng thể nаo ủy quyền cho
người khбc chứng hфn ở ngoаi địa hạt của mмnh được.</span></p>

Nghi thức Hфn nhвn Cфng giбo thường được cử hаnh trước mặt ba người: vị
chứng hфn vа hai người lаm chứng (x. Điều 1108 §1).</span></p>

<span style="box-sizing: border-box; font-family: arial, helvetica, sans-serif; font-size: 14px">
Hai người lаm chứng phải hiện diện cбch thể lэ vа cщng một lъc với với
vị chứng hфn. Nếu thiếu vắng một hay hai nhвn chứng nаy, sự cử hаnh kết
hфn vф hiệu.</span></p>

Khбc với vị chứng hфn lа người khфng bị ngăn trở về giбo luật (khфng bị
mắc vạ, theo như Điều 1109) vа cу thẩm quyền “để yкu cầu hai bкn kết ước
biểu lộ sự ưng thuận vа để nhвn danh Giбo Hội chấp nhận sự biểu lộ ấy”
(Điều 1108 §2), hai người lаm chứng chỉ cần thuần tъy hiện diện vа chứng
kiến lъc đфi hфn nhвn trao đổi sự ưng thuận.</span></p>

<span style="box-sizing: border-box; font-family: arial, helvetica, sans-serif; font-size: 14px">
Vм thế, chỉ cần hai người lаm chứng nаy biết sử dụng trн khфn, nghĩa lа
họ cу khả năng hiểu biết một hфn phối đang được kэ kết qua lời trao đổi
ưng thuận của đфi hфn nhвn. Bất cứ người nаo cу năng cбch để lаm chứng
theo luật tự nhiкn thм đều cу thể lаm nhвn chứng hợp phбp cho Hфn nhвn
Cфng giбo, khфng kể họ lа nam hay nữ; cу đạo Cфng giбo hay lа lương dвn;
giбo sĩ, tu sĩ hay giбo dвn, thậm chн đang bị vạ tuyệt thфng cũng được.</span></p>

<span style="box-sizing: border-box; font-family: arial, helvetica, sans-serif; font-size: 14px">
Giбo luật khфng quy định số tuổi tối thiểu của người lаm chứng Hфn phối,
chỉ đтi hỏi họ biết sử dụng trн khфn. Vа Giбo luật giả định rằng trẻ em
đг được bảy tuổi trọn thм đг biết sử dụng trн khфn (x. Điều 11). Nhưng
tốt hơn hết lа nкn chọn những người từ mười bốn tuổi trở lкn, vм chưng
Giбo luật cũng quy định khфng được nhận lаm nhвn chứng những người vị
thаnh niкn dưới mười bốn tuổi trong cбc tố tụng theo giбo luật (x. Điều
1550 §1).</span></p>

Hфn nhвn chỉ thаnh sự khi được kэ kết trước mặt vị chứng hфn cу năng
quyền (Đấng Bản Quyền địa phương hay cha sở), hoặc một tư tế hay một phу
tế đг được một trong hai vị trкn uỷ quyền, trước mặt hai nhвn chứng, vа
trong giới hạn địa hạt thẩm quyền của mмnh. Đвy chỉ mới lа trường hợp
kết hфn theo thể thức thфng thường. Trường hợp thể thức kết hфn ngoại
