sư”, R.P. Murray đã nói rằng: Các luật sư Công Giáo có thể bào chữa cho
trường hợp của đương sự từ chối ly hôn trong một hôn nhân hợp pháp; bào
chữa cho trường hợp của đương sự có hôn nhân bị Giáo Hội tuyên bố vô
hiệu; bào chữa cho trường hợp của đương sự chỉ muốn bảo vệ các quyền hợp
pháp, chứ không ly dị vì muốn tái hôn. “Theo đó, ngoài những trường hợp
hiếm hoi này, luật sư Công Giáo phải từ chối tham gia tố tụng cho vụ án
ly hôn cho dù các bên liên quan không phải là người Công Giáo, vì giả
định là họ tin rằng hôn nhân là bất khả phân ly.”</span></p>

Trước năm 1965, tức là trước cuộc bùng nổ của cái gọi là luật ly hôn “vô
tội”, nhiều luật dân sự có những quy định tương đối nghiêm ngặt, thậm
chí là khắt khe, liên quan đến việc ly hôn. Chẳng hạn, luật của<span class="Apple-converted-space"> </span><st1:state w:st="on" style="margin: 0px; padding: 0px;"><st1:place w:st="on" style="margin: 0px; padding: 0px;">New
York</st1:place></st1:state><span class="Apple-converted-space"> </span>trước
năm 1965 chỉ cho phép ly dị trong trường hợp có ngoại tình. Điều này dẫn
tới việc có một số người rời bỏ tiểu bang, còn những người ở lại thì
phải khai man để được ly hôn. Việc khai man này cũng là một lý do khác
giải thích tại sao các luật sư Công Giáo chân chính không nên dính líu
vào các thủ tục ly hôn.</span></p>

Đồng thời, Công Đồng Vatican II đã than phiền “cơn dịch ly hôn” như là
một trong “những quái dạng” làm lu mờ đi nét tuyệt hảo của hôn nhân.
Theo Công Đồng, không chỉ sự thiện hảo của cá nhân nhưng sự thiện hảo
của xã hội con người và Kitô giáo cũng được nối kết mật thiết với hôn
nhân bền vững và đời sống gia đình.</span></p>

Tuy nhiên, giáo luật cũng cho phép ly thân (GL 1151-1155) với điều kiện
không được tái hôn. Xuất phát từ đức ái Kitô giáo và mối bận tâm điều
tốt đẹp cho gia đình, giáo luật cũng khuyến khích bên bị hại hãy tha thứ
những lầm lỗi cho bên kia và đừng chia cắt đời sống hôn nhân (GL 1152,
triệt 1). Tuy nhiên, nơi nào có mối nguy hại lớn cho linh hồn hay thể lý
của người khác hay cho trẻ em, hay nơi nào “đời sống chung” trở nên quá
khó khăn, thì có thể ly thân theo luật (Gl 1153, triệt 1).</span></p>

Tuy nhiên, vì Giáo Hội muốn nâng đỡ hôn nhân nên, vì đức ái Kitô giáo
cũng như vì điều tốt đẹp cho gia đình, luật sư Công Giáo nên cố gắng hòa
giải giữa họ để bảo vệ tầm quan trọng của hôn nhân bất khả phân ly, cho
dù việc hòa giải đó có thể không thành công. Với nền tảng này, chúng ta
có thể đọc thấy những dòng sau trong Giáo Lý Giáo Hội Công Giáo: “<em style="margin: 0px; padding: 0px"><span style="font-family: Arial; margin: 0px; padding: 0px">Nếu
sự ly dị theo toà đời là cách duy nhất để bảo đảm một số quyền lợi chính
đáng, để lo cho các con hoặc để bảo vệ di sản, thì có thể được dung thứ
và không tạo thành một lỗi phạm nào về luân lý</span></em>” (Gl 2383).</span></p>
