Theo Giáo luật hiện hành thì em bé có thể được lãnh nhận bí tích Rửa tội.</span></p>

Giáo luật điều 868 qui định:</span></p>

Ðể một nhi đồng được rửa tội cách hợp pháp, cần thiết phải:</p>
<p style="text-align: justify; text-indent: 15.0pt; margin: 4.5pt 0cm">1. có
sự đồng ý của cha mẹ, ít là của một trong hai, hoặc của người thế quyền cha
mẹ theo luật;</p>
<p style="text-align: justify; text-indent: 15.0pt; margin: 4.5pt 0cm">2. có
hy vọng vững chắc rằng em bé sẽ được giáo dục trong đạo công giáo. Nếu hoàn
toàn không có hy vọng, thì phải hoãn việc rửa tội dựa theo các quy định của
luật địa phương, sau khi đã cho cha mẹ biết lý do.</p>

Trong cơn nguy tử, một nhi đồng con của cha mẹ công giáo, và thậm chí không
công giáo, có thể được rửa tội cách hợp pháp, cho dù trái ý cha mẹ.</p>

Thiết nghĩ em bé có đủ hai điều kiện mà Giáo luật đòi hỏi: (1) chính hai vợ
chồng xin cho em bé được rửa tội, (2) có lý do để hy vọng em bé sẽ được giáo
dục trong đạo công giáo bởi hai vợ chồng là người công giáo, và vẫn trung
